These Terms and Conditions ("Terms") govern your use of the website tsfans.com ("Website"), operated by CreatingStars OÜ, a company registered in Estonia at Harju maakond, Tallinn, Kesklinna linnaosa, Kaupmehe tn 7, 10114 ("Company", "we", "us",or "our"). By using this Website, you agree to be bound by these Terms. If you do not agree with these Terms, do not use the Website.

  1. Eligibility

    1. You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is greater, to use this Website.

    2. By registering an account, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and truthful.

  2. Account Registration

     

    1. Content Creators must undergo a mandatory identity verification process before publishing any content. This includes:

      • A high-resolution photograph of a valid government-issued ID (front and back) or a

        passport.

        A valid proof of address (e.g., utility bill or bank statement dated within the last 3 months).

      • Signing the Content Creator Agreement.

         

    2. Content Creators are solely responsible for the content they upload. By signing the Content Creator Agreement, they agree to indemnify and hold harmless CreatingStars OÜ from any and all claims, liabilities, damages, and expenses arising from their content.

    3. Content featuring any individual who has not been verified and approved by CreatingStars OÜ is strictly prohibited. Violation of this rule will result in immediate account termination and reporting to relevant authorities.

       

  3. User Conduct

     

    1. Users who are not Content Creators may view and interact with published content but are prohibited from:

      • Requesting or encouraging illegal acts from Content Creators.

      • Engaging with Content Creators outside of the Website.

    2. Any request to engage with a Content Creator outside the Website or to participate in illegal activities may result in a permanent ban and notification to appropriate authorities.

    3. All users must adhere to a respectful and lawful standard of behavior. Harassment,

      hate speech, or abusive conduct will not be tolerated.

       

  4. Prohibited Content

     

    1. The following content is strictly prohibited and will be removed immediately:

      • Content involving minors (under 18) or individuals without valid consent and verification.

      • Content that promotes or involves illegal activities, violence, or abuse.

      • Non-consensual content or content that violates privacy rights.

    2. Illegal content will be reported to the relevant authorities of the jurisdiction involved, and the user or creator responsible will be permanently banned.

    3. Users may not use any content that infringes on third-party intellectual property rights. If you believe your copyrighted material has been used without authorization, please contact us to request removal in accordance with applicable laws.

    4. Users and visitors may report any content on the Website, for any reason, by emailing our support team at: support@tsfans.com.

       

  5. Compliance with Laws and Regulations

     

    1. All users must comply with:

      • Local, national, and international laws and regulations.

      • Rules and regulations of card schemes (e.g., Visa, MasterCard) to ensure compliance in processing payments.

      • Anti-money laundering (AML) and know-your-customer (KYC) policies.

    2. We reserve the right to refuse or terminate access to the Website for any user who fails to comply with applicable laws or our internal compliance requirements.

    3. Disputes must first be attempted to be resolved via email or digital mediation before formal legal proceedings.

    4. Users and Creators who receive confidential business or technical information from the Company must not disclose it to third parties without explicit written consent.

    5. The Company reserves the right to remove any content at its sole discretion if it is found to jeopardize the platform’s legal compliance, reputation, or relationships with partners.

    6. Users are required to maintain the security of their accounts, including enabling two-factor authentication (2FA) where available.

    7. These Terms shall remain binding in the event of the sale, transfer, or restructuring of CreatingStars OÜ or its assets.

       

  6. Payments and Transactions

     

    1. All transactions must be conducted through the Website's approved payment processors.

    2. Users agree not to attempt to circumvent the payment system, and any such attempt will result in immediate termination of the account.

    3. Refund policies are generally governed by the policies of individual Content Creators. However, tsfans.com may issue refunds at its discretion in cases of fraud, content misrepresentation, or technical failure. Users must contact support@tsfans.com to initiate a request.

       

  7. Creator Support Policy

     

    1. Verified Content Creators are entitled to platform support, including:

      • Assistance with technical issues or content uploads

      • Clarification on account status, monetization, and policy violations

      • Response to inquiries within 1–3 business days via support@tsfans.com

    2. The Company reserves the right to prioritize cases based on urgency and compliance risk.

       

  8. AI and Deepfake Content Policy

     

    1. AI-generated or deepfake content is permitted only if:

      • It is clearly labeled as AI-generated;

      • It does not impersonate any person (real or fictional) without their explicit, verifiable consent.

    2. Misuse of AI or synthetic media to mislead users, impersonate individuals, or replicate nudity without consent is grounds for permanent suspension.

       

  9. Brand Usage Guidelines

    1. Content Creators and users may use the tsfans.com name or logo for promotional purposes only with:

      • Written permission from the Company;

      • Compliance with visual and brand integrity guidelines shared by the Company.

    2. Use of our brand in misleading or disparaging ways is strictly prohibited and may result in legal action.

       

  10. Termination and Suspension

    1. We reserve the right to suspend or terminate any account at our discretion, especially in cases of fraud, abuse, or breach of these Terms.

    2. Users whose accounts are terminated for cause will not be entitled to any refunds.

  11. Limitation of Liability

    1. The Company is not liable for content posted by third-party users.

    2. By using the Website, you acknowledge and accept that all content is the responsibility of the user who created it.

  12. Changes to the Terms

     

    1. We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Website.

    2. Continued use of the Website after such changes constitutes acceptance of the revised Terms.

       

  13. Governing Law and Jurisdiction

     

    1. These Terms are governed by the laws of the Republic of Estonia.

    2. Any disputes will be resolved in the competent courts located in Tallinn, Estonia.
